Terms and Conditions of Sale (EU, US and other markets)

These terms apply to purchases of Kimogino products delivered outside Norway, including the 27 EU member states, the United States and other supported destinations. Nothing here limits mandatory consumer rights you have under the law of your country of residence.

1. Parties

The seller is Kimogino, Hermann Schmidt, Norwegian organisation number 938 221 782, Granlia 4, 1900 Fetsund, Norway. Email: Kimogino.ai@gmail.com. The seller is referred to as "we" or "Kimogino".

The buyer is the adult (18 or over) named as buyer on the order and holding the Kimogino account the order was placed from, referred to as "you". The contract is formed when we send you an order confirmation by email.

2. Payment

• Payment is taken at the Shopify checkout using the methods shown there, typically payment cards, Apple Pay and Google Pay.
• The full amount is charged when the order is confirmed, because items go into production immediately.
• EU orders are priced in euro (EUR) and include applicable EU VAT. US orders are priced in US dollars (USD); any sales tax, duties or import fees are calculated and shown at checkout before you pay.
• Shipping and any handling fees are calculated for your delivery address and shown separately at checkout before you confirm.
• Digital picture packs in the Kimogino app are sold separately, charged by card through Stripe, and are one-off purchases that never renew.

3. Delivery

Products are made to order and printed by our production partner. Production time, estimated delivery time and shipping cost are calculated for your delivery address and displayed at checkout before payment. Those figures form part of the contract.

• We deliver to Norway, the 27 EU countries and the United States.
• Risk passes to you when you or your nominated recipient takes possession of the goods.
• If delivery is delayed we notify you by email with a revised estimate. If delivery is materially delayed you may cancel the order and receive a full refund including shipping.
• If a parcel is lost or delivered to the wrong address, contact us within 30 days of the expected delivery date and we will reship or refund.

4. Right of withdrawal

EU buyers. Under the EU Consumer Rights Directive you normally have 14 days to withdraw from a distance purchase. That right does not apply to goods made to your specification or clearly personalised (Article 16(c)). Kimogino products are printed with artwork you created, so the right of withdrawal ends once production has started.

US buyers. There is no general statutory cooling-off period for online purchases in the United States. The cancellation window and the remedies below apply to you as a contractual right, in addition to any rights under applicable state law.

• You may cancel free of charge before your item enters production. Email Kimogino.ai@gmail.com with your order number as soon as possible after ordering. We confirm the cancellation and refund in full if production has not started.
• Any non-personalised item keeps the full 14-day withdrawal right from the day you receive it, for EU buyers.
• Digital picture packs follow our refund policy.

5. Returns

Kimogino pays all return shipping. You never pay postage to send something back to us.

• Email Kimogino.ai@gmail.com with your order number and a short description. We send you a prepaid return label and the correct return address at our production partner's facility. Do not send returns to our postal address unless we ask you to.
• Items must be sent back within 14 days of telling us you want to return them.
• We refund to your original payment method within 14 days of receiving the item, or of you providing proof that it was sent back.

6. Complaints and defective products

If an item arrives damaged, misprinted, in the wrong size or colour, with the print in the wrong place, or otherwise not matching your order, contact us as soon as you notice.

• Email Kimogino.ai@gmail.com with your order number and photos of the fault and the product label. In most cases we do not need the item back.
• We reprint the item free of charge, or refund you in full including shipping.
• EU buyers have a two-year legal guarantee against lack of conformity from delivery, under Directive (EU) 2019/771 and national implementing law. US buyers may claim a replacement or refund under this section, in addition to any applicable state warranty rights.
• Normal wear, damage from misuse or washing contrary to the care label, and small colour differences between screen and print are not defects.

7. Dispute resolution

Always contact us first at Kimogino.ai@gmail.com. We answer complaints as quickly as possible and within 30 days at the latest.

• EU buyers. If we cannot agree, you may use the European Commission's Online Dispute Resolution platform, or contact the consumer dispute body or European Consumer Centre in your country.
• US buyers. We will try to resolve any dispute informally. If that fails, disputes are settled by the courts of Norway, unless mandatory law in your state gives you a different forum.
• These terms are governed by Norwegian law. This choice of law does not deprive you of the protection of mandatory consumer rules in your country of residence.
